Doli Incapax is a legal principle meaning "incapable of committing a crime." This concept recognizes that certain individuals, due to age or mental capacity, cannot form the criminal intent (Mens rea) required to be held criminally responsible for their actions.
Under the Bharatiya Nyaya Sanhita (BNS)
• Section 20 BNS: This section provides absolute immunity to children under the age of seven. It is presumed that they lack the maturity to understand the consequences of their actions and, therefore, cannot be held criminally liable. This is known as absolute doli incapax.
• Section 21 BNS: This section extends a qualified immunity to children aged between seven and twelve years. In this case, the child can be held criminally responsible if it can be shown that they had the maturity to understand the nature and consequences of their actions.
