4/ Fiqh of Marriage: Rights & responsibilities, divorce
*Marital Intimacy*
Mutual intimacy is ideal in marriage. While Islamic teachings emphasize the husband's right to intimacy, the wife's needs and satisfaction are also important. Refusal without valid reason is considered a sin for the wife. Pre-existing or post-marital lack of desire in the husband may be grounds for divorce at the wife's request.
*Marital Rights and Responsibilities*
Ideally, husband and wife are each other's "cover," a close, unified relationship. Discussions of rights usually arise only during disputes. Compromise and forgiveness are crucial. Even if a husband loses feelings for his wife, it's Sunnah (recommended practice) to maintain the marriage, earning reward for both spouses.
*Marriage Announcement (Walima)*
Publicly announcing a marriage (Walima) is Sunnah. This prevents misunderstandings and potential social issues. The Walima feast is also Sunnah, even if modest. Attending a Walima is mandatory unless certain conditions are met (e.g., haram activities present).
*Conditions for Attending Walima*
The first Walima is mandatory; subsequent ones are discouraged.
The host must be Muslim.
The host must not have committed kufr (acts that negate faith).
Attendance should be for the sake of Allah, not personal gain.
The event must be free of haram activities (alcohol, inappropriate mixing of genders).
*Divorce (Khul')*
Khul' allows a wife to initiate divorce, typically by offering compensation to her husband if he hasn't wronged her. The husband ultimately decides. Islamic law prioritizes reconciliation. If a wife genuinely lacks feelings and cannot maintain the marriage, divorce may be granted, even without the husband's initial consent, with the intervention of a judge.
