TOO CLOSE TO CALL: Proximate Cause in Palsgraf | Tort Law

Today, we're looking at Palsgraf v. Long Island R. Co., 248 N.Y. 339 (N.Y. 1928). In this case, Judge Cardozo laid out the concept of proximate cause in negligence cases for torts. In looking to proximate cause, Judge Cardozo generally found there needed to be a reasonable apprehension of a harm. If it was too weird, too unforeseeable, it was a step too far, and there was no proximate cause for purposes of the claim.
