What is Section 425 IPC & Section 435 IPC | Public Property Damage #IPC425 #IPC435 #PublicProperty
Section 425 of the Indian Penal Code (IPC) defines the general offense of "mischief", which covers intentionally causing wrongful loss or damage to any property, whether public or private. Section 435 of the IPC is an aggravated form of mischief that specifically deals with damage caused by fire or explosive substances.
Section 425 IPC: Mischief
Section 425 defines mischief as causing wrongful loss or damage to the public or any person with intent or knowledge that such an act is likely to cause this. This involves destroying or changing property to diminish its value or utility. Key elements include the required intent or knowledge, damage to any property (movable or immovable), resulting destruction or damage, and causing wrongful loss. Simple mischief under Section 426 IPC is punishable with up to three months imprisonment, a fine, or both.
Section 435 IPC: Mischief by Fire or Explosive Substance
Section 435 addresses mischief caused by fire or explosive substances with the intent to damage property valued at 100 rupees or more (or 10 rupees for agricultural produce). This offense includes all the elements of Section 425 but specifies the method of damage (fire or explosives) and requires the damage to meet a certain monetary threshold. The punishment under Section 435 IPC can be imprisonment up to seven years and a fine.
Public Property Damage
Both Sections 425 and 435 cover damage to public property, as the definition includes "wrongful loss or damage to the public or to any person". Additionally, other specific sections of the IPC, such as Sections 431 and 432, address damage to public infrastructure like roads, bridges, and drainage systems, with punishments varying based on the nature and severity of the damage.
