Pretrial Diversion Programs -- "How do They Work?"

Here in California there are several pretrial diversion programs, by which eligible defendants can get their charges dismissed and keep their record clean, if they abide by the program's requirements. These requirements often include:

1.) Paying restitution

2.) Completing a drug or alcohol rehabilitation program

3.) Performing community service

and 4.) Avoiding any new arrests

If all of these steps are successfully completed, then the charges will be dropped. However if the defendant fails to complete the pretrial diversion program, they will be prosecuted for the original offense, and could face possible jail time if convicted, along with a criminal record.

These pretrial diversion programs are normally only available to first-time offenders of low-level misdemeanors such as drug possession, solicitation of a prostitute, or shoplifting.
