When should you start parenting time or custody motion for summer? A lot of people are making the mistake of scheduling the filing of their motions. Summer starts in mid-June, so we better talk to our lawyer and file the motions. You want to modify parenting time for summer. Let’s file the motions this May. Filing motions this May is a bit too late. The court is very deliberate when it comes to children, child custody, and parenting time. The least you should be doing is filing the motion in February and even that is being optimistic. Some counties may not have recovered from the COVID disruptions yet. They are still dealing with the effect of the disruptions. If you are already planning out summer, you better file your motion before New Year. Speak to your ex-spouse, your co-parent. File a motion. Serve the papers. Get it before the judge and have the judge schedule an evidentiary hearing. Attend the hearing and get the order. You have to embrace the reality that even in the scheduled hearing you may not get the order you want.
