आपसी सहमति से तलाक का मतलब है:
👉 पति और पत्नी दोनों यह मान लेते हैं कि वे अब साथ नहीं रह सकते

• कोई आरोप-प्रत्यारोप नहीं होता
• लंबी कोर्ट की लड़ाई नहीं होती
• प्रक्रिया अपेक्षाकृत सरल होती है

⚖️ 2. कानूनी प्रावधान (Legal Provisions)
• भारत में यह तलाक निम्न कानूनों के तहत होता है:
• Hindu Marriage Act, 1955 – धारा 13B (for Hindus, Buddhists, Jains, Sikhs)
• Special Marriage Act, 1954 – धारा 28 (for inter-religion or civil marriages)
• The Divorce Act 1869 – धारा 10A (for Christian) इनके तहत पति और पत्नी संयुक्त याचिका (Joint Petition) दाखिल करते हैं।

⚖️ 4. पूरी प्रक्रिया (Step-by-Step Procedure)

📝 Step 1: संयुक्त याचिका दाखिल करना दोनों पक्ष Family Court में संयुक्त याचिका दाखिल करते हैं।

📝 Step 2: पहला मोशन (First Motion) • कोर्ट दोनों के बयान दर्ज करता है • सहमति की पुष्टि करता है

📝Step 3: आपसी तलाक में काउंसलिंग / मेडिएशन क्या है? • काउंसलिंग या मेडिएशन वह प्रक्रिया है जिसमें कोर्ट द्वारा नियुक्त काउंसलर/मेडिएटर पति-पत्नी से बात करके यह समझने की कोशिश करता है कि:

• सामान्यतः 6 महीने का समय दिया जाता है

📝Step 5: दूसरा मोशन (Second Motion)
• 6 महीने के बाद or after weaved off the cooling period, दोनों फिर कोर्ट में उपस्थित होते हैं • अंतिम सहमति देते हैं
