Felonies, Misdemeanors, Infractions and Wobblers in California

California criminal offenses are generally divided into three categories: infractions, misdemeanors, and felonies. Infractions are the least serious offenses and usually involve fines without jail time, such as many traffic violations. Misdemeanors are more serious and can carry penalties of up to one year in county jail, probation, fines, and a criminal record. Felonies are the most serious criminal charges and may result in state prison sentences, substantial fines, and long-term consequences involving employment, immigration, and firearm rights. California also recognizes “wobbler” offenses, which are crimes that prosecutors can charge as either misdemeanors or felonies depending on the facts of the case, the defendant’s criminal history, and the severity of the alleged conduct.
