SC Upholds Pedestrians’ Right to Safe Footpaths | Local Bodies Held Responsible for Public Safety

The Supreme Court has made it clear that the construction, maintenance, and safety of footpaths along roads is the responsibility of local bodies. A bench comprising Justice PS Narasimha and Justice MS Chandurkar emphasized that walking on designated footpaths is a fundamental right guaranteed to all citizens under the Constitution, and pedestrians must be given higher priority than vehicular traffic. The ruling came in response to a case where a young boy was fatally struck by a lorry from behind while walking to school with his father, after which the father approached the court citing deficiencies in the pedestrian pathway and seeking compensation. The Supreme Court ruled that citizens have the legal right to take action against the concerned authorities when their right to safe walking is violated. The court enhanced the compensation awarded by the lower courts to ₹11.44 lakh and directed the concerned parties to pay the amount within two months.
