Confusion and rumors about the EB3 process have increased after the recent immigration visa halt discussions. Many people mistakenly believe that approval of an I-140 means automatic permission to stay in the USA. That is not true.

An approved I-140 is only an employer’s immigrant petition approval. A person may still need:
• A current priority date
• Valid immigration status
• I-485 eligibility or consular processing
• Compliance with U.S. immigration laws

Overstay, visa category, unlawful presence, and visa bulletin issues can still affect the case even after I-140 approval.
