Blood Alcohol Content Greater Than .15 Explained | Austin Criminal Defense

Austin Criminal Defense Attorney Charlie Roadman explains the legal consequences of having a Blood Alcohol Concentration (BAC) of .15 or higher in a Texas DWI case. In 2011, the Texas legislature introduced an enhancement for cases where a person's BAC is .15 or greater. This enhancement elevates the offense from a Class B to a Class A misdemeanor. As a result, the maximum potential jail time increases from 180 days to a year.

Charlie notes that while it's unlikely to result in the maximum penalty, the range of punishment is more severe with this enhancement. The BAC level can be indicated on a bond document if measured by a breathalyzer. If blood tests are used, the BAC may not be known immediately, but if it's later found to be .15 or higher, the charge will be upgraded to a Class A misdemeanor. Charlie also clarifies that the BAC could be significantly higher than .15, even if the bond document just indicates it as .15 or greater.
