What can workers' comp do with the film they got of me? Who can they send it to?

This video reviews issues surrounding the workers' comp insurance company hiring an investigator to get secret film of an injured worker. If you are an injured worker with a California injury, and don’t have an attorney, this video is intended to help provide an overview of workers’ compensation topics so you can better represent yourself.

One thing I left out of the video is that workers' comp can also send the video to the local District Attorney for a potential fraud investigation and prosecution. That could be the case if the injured worker was clearly exceeding his or her abilities as told to the doctors. Of course, making any knowingly false or fraudulent statement for the purposes of obtaining workers' comp benefits can be a felony, and my videos are aimed at actual injured workers who are sincerely trying to heal from their injury and get back to work.

Jeremy Lusk is a certified specialist in workers’ compensation with about two decades of experience, and previously served as a Judge at the Fresno District Office of the WCAB. He has worked out of Fresno, but appeared at numerous Boards to represent both injured workers and employers/carriers.
