In this SHORT video, Washington criminal defense attorney Ryan Witt explains how there is no requirement for the government to prove that a driver is impaired for the crime of DUI.

Washington is a "per se" State, meaning that if the government can prove a driver is over 5 ng/ml for marijuana, or .08 blood or breath test for alcohol, there is no requirement that the State show the driver displayed any impairment. This is certainly more controversial for marijuana DUI's, because nearly all marijuana users will show no effects from their marijuana use at a level of 5 ng/ml.
