Can you get a visa if you have a criminal conviction and other immigration FAQs

Hey everyone, Barry here with the LawFull channel, in Evanston Illinois again with Alen Takhsh, managing partner of the immigration law firm Takhsh Law.

In this video we’re addressing the first five of the top 10 questions immigration lawyers get asked including can you get a visa if you have a criminal record?

The most common question Alen gets asked is do I need a lawyer for an immigration case. The answer is no. You don’t need a lawyer. Surprised? However, if you dig a little deeper, it is probably advisable to get a lawyer. The immigration process is complicated especially now with the current political climate. As such, getting an attorney who knows what he/she is doing can only benefit you.

The second most frequently asked question is how do immigration attorneys charge for their services. The answer, at least in Alen’s case is that he charges on a flat fee basis. That brings certainty to the process. That way the client knows exactly how much his services are going to cost before he signs him up.

The third most FAQ Alen gets asked is whether he can guarantee his client will win his or her immigration case. The answer is no. It seems like the answer should be black or white, you qualify or you don’t but that is not the way it is. In fact, it would be unethical for Alen to guarantee an outcome.

The fourth most frequently asked question is can I get a visa if I have a criminal conviction. This could apply to felony or misdemeanor convictions. The answer is ‘it depends.’ That’s why Alen asks clients to get certified dispositions of all their criminal cases so that he can review them before you file. In short, your attorney needs to know about any criminal convictions you have before you file. In fact, you should tell your attorney about your immigration history. Like if someone petitioned for you previously. Your immigration attorney can then file a Freedom of Information Act request from USCIS or Immigrations Customs Enforcement or Customs and Border Protection in order to obtain immigration files before anything is filed.

The fifth and final question in this video is can you travel while an asylum case is pending? First, the asylee cannot return to the country they’re seeking protection from but they could meet their loved one in a third safe country. But how does traveling affect your case. Alen always tells his clients not to travel. It could jeopardize your asylum case unless you have an opportunity to return by way of advanced parole. Even if it is issued, he recommends you do not travel because of the geo-political climate.

However, once you are granted asylum, you can apply for an asylee travel document until you get your green card. Then once you have your green card you can travel easier and with more peace of mind.
