Don't Make This Mistake With Your Trademark!

Starting a new business is great, but don't make this mistake with your trademark!

I came across a post from a Facebook friend, and he said, we're starting a new business, and we've decided to name it "Fabulous Consulting!" (Name has been changed to avoid embarassing anyone)

I love it when people start new businesses, and I hate to see them making mistakes, so I emailed this person, and said, "Hey, congrats on the new business, but you may want to reconsider that trademark name. You won't be able to get that reegistered on the Principal Register, because it will be considered "merely descriptive" because of the launditory nature of the trademark. Let me know if you would like to talk with me to discuss."

He thanked me, and said that he already had an attorney involved, but that the attorney hadn't talked about the issue that I mentioned. This is because the attorney involved likely doesn't specialize in trademark law; a general business attorney likely wouldn't recognize this issue.

When you're starting a new business, be sure to find someone who specializes in trademark law to evaluate the strength of your trademark and the liklihood that you'll be able to protect it with a Federal Trademark Registration. It's hard to build a brand on a trademark that you can't register.
