In this video, Attorney Steve®, California Civil Litigation Attorney, discusses the civil tort concept of “Res Ipsa Loquitur.” This is a evidentiary concept that means “the thing speaks for itself” and is used in Negligence cases to avoid a directed verdict or dismissal of the case. It creates a rebuttable presumption or inference of negligence that shifts the burden of proof to the other side (Plaintiff) where:

1. Defendant was in exclusive control of the instrumentalities that caused the injury

2. The incident is the type of which is not likely to occur without negligence.
