Compelling Circumstance (I-140) EADs are available to individuals and families in certain nonimmigrant statuses, with an approved I-140, who find themselves in particularly difficult situations generally outside their control. While the EAD does not grant legal status, it does provide protection against any unlawful presence, regardless of whether or not the application is
ultimately approved. Due to the fallout of the COVID-19 pandemic, the I-140 EAD will likely serve as the only lifeline for many families whose Green Card path has been abruptly halted.
