Can the VA Reduce Your Disability Rating for PTSD?
In this video, I'm going to explain why the VA can reduce your disability rating for PTSD. We will discuss the PTSD rating reduction process and I will give you some tips and homework that you can use the prevent the VA from sending you a PTSD rating reduction notice.
In fact, I used the strategies in this video to prevent the VA from doing exactly that!
I have a protected disability rating because I am 100% P&T and that gives me a protected rating.
In order for VA to reduce your rating, you are going to need to show sustained improvement on your disability. I am a combat veteran and I have suffered from PTSD for 28 years so I know that I am not going to get better but I am going to try.
Frankly speaking, if your PTSD has only shown temporary improvement, your rating can’t be reduced.
If you have had the same rating for 20 years or more, the VA can’t reduce that rating except in cases where the VA can prove fraud. This is true for all VA disabilities. Don't file a fraudulent VA claim and you won't have to worry about this problem.
Material Improvement, In order to reduce a rating of 100% (on an individual or combined rating), the VA must schedule an exam where they can determine that there has been an obvious material improvement in your condition.
If there is proven improvement, the VA must still determine whether or not you can qualify for TDIU (Total Disability Individual Unemployability). Even if I were to have a reduction, I still cannot work so I would remain at 100& P&T because TDIU would kick in.
