🎥 How Does Denaturalization Actually Happen? ⚖️🇺🇸

Before anyone can lose U.S. citizenship, a formal investigation must take place.

Here’s how the process works:

📌 USCIS conducts the investigation
USCIS is responsible for identifying and investigating potential fraud related to how citizenship was obtained.

📌 USCIS does NOT revoke citizenship
If USCIS believes the evidence supports denaturalization, it refers the case to the Department of Justice (DOJ).

📌 The DOJ files a case in federal court
The Department of Justice brings a civil complaint in U.S. District Court, and formal court proceedings begin.

⚠️ The burden of proof is on the government
The government must prove its case and meet a high legal standard before citizenship can be taken away.

Examples may include proving:
• Fraud during the green card process
• False statements on the N-400
• Willful misrepresentation of material facts

👩‍⚖️ A federal judge makes the final decision
After court proceedings, the judge may:
✔️ Allow the person to keep U.S. citizenship, or
❌ Revoke citizenship

If citizenship is revoked, the person typically reverts to their prior immigration status.

👉 Denaturalization is serious, complex, and not automatic — the government must prove its case in court.
