Are You and Your Disability Lawyer on the Same Page
Social Security disability is a long and often frustrating process. Your case can take two to three years from the date you file your application until the date of your hearing before a Social Security disability judge.
As I discuss in this video, I am very careful about the cases I accept into my office. First, I can only accept cases where there is a reasonable chance of success and where there will be past due benefits that can be used to pay my fee.
Like every lawyer in the disability practice area, I enter into a contingency fee contract with my clients whereby I get paid 25% of past due benefits, with a cap of $6,000. If someone reaches out to me who is not insured for SSDI, or who has a very minor medical problem, or who is an active alcoholic or drug abuser, the chances of winning and recovering a lump sum representing past due benefits is almost non-existent and I will decline representation.
Second, I will only work with clients who are reasonable people with reasonable expectations. If a potential client badmouths his prior lawyer, that is a red flag. If a potential client expects a 30 minute phone call every week, that is not a reasonable expectation in a 3 year representation and I will decline representation.
You can and should have your own expectations from me or from any disability lawyer you hire. If you have a question, you should expect a response by phone or email within 24 to 48 hours. If you want to talk to your lawyer about the working theory of disability for case, your lawyer should make time to speak with you. If you would like a likely timeline or status update periodically, that is reasonable as well.
Regardless of what you read on the Internet or what anyone may tell you, your lawyer has no control over Social Security’s processing of your case. Your lawyer derives no financial benefit out of SSA’s long delays as legal fees are capped.
If you understand that the disability decision making process is long, not well explained by SSA and frustrating but you have faith that your lawyer has your interests at heart and wants a chance to present your case as quickly and thoroughly as possible, your experience in the disability system will be as pleasant as it can be. #atlantasocialsecuritydisability #georgiassdi #georgiasocialsecuritydisabilityattorney
