Canned Heat 'Going Up The Country'' 1970 (Plagiarism)

I love this record, BUT it's merely a re-working of the 1928 Henry Thomas classic "Bull Doze Blues" ( https://youtu.be/6bO0kp4lAPo ) ....some people say "stole"...pretty much note for note with different lyrics. The flute line is approx 32 copied consecutive notes. Given that the original was only 40 years old in 1968, as Henry Thomas released his record in 1928, it was not yet in the public domain....only songs released before 1926 were automatically PD (Public Domain) *** in the USA. Numerous other traditional old songs that were remade like "Scarborough Fair" are actually PD, as that particular song was an (approx) 400 year old English folk song...entirely different to the Canned Heat situation. Another example is "House Of The Rising Sun" which dates back to a pre-1900 English folk tune with lyrics altered to be situated in New Orleans...lyrics being 1st published in 1905...so therefore, yes, PD (Public Domain). "Happy Birthday" was copyrighted to the Hills sisters (who renewed its copyright) from 1893 right up until the Warner Bros lawsuit in 2015, when they had to pay back millions when it was discovered/proven that it was actually PD. "Jingle Bells" was first published in 1857 & is in the PD too.
