How OIN Ensures Patent Non-Aggression

Keith Bergelt, CEO of Open Invention Network (OIN), takes the stage at FOSS Asia's annual conference to explain how OIN is an enabler of Open Source and what that means for businesses of all sizes in all industries. The organization safeguards Open Source and helps its community members reduce patent risks in core Linux and adjacent Open Source technologies. Additionally, OIN fosters community collaboration in support of Open Source innovation.

The community does not require a monetary exchange, but instead members agree they will not sue any OIN members or litigate against any core Linux-related or Open Source technology. In return, members share, or cross-license their patents with other members and receive royalty-free access to other member patents, as well as OIN-owned patents among many other community benefits.

The coverage area, or scope of the OIN community cross-license, is defined by a list of software packages known as the Linux System Definition which includes core Linux and adjacent Open Source technologies. The Linux System Definition expands over time and is periodically updated.
Companies join OIN from across the world, but the organization is increasingly seeing growth from businesses in the Asia Pacific Region. The only reason companies aren’t joining OIN is because they want to reserve the right to sue.
