Is There a Formula to Guarantee Success for Disability?
Is there a formula to guarantee an approval of your Social Security disability case? Unfortunately there are no guarantees in the SSD process, but there are certain characteristics of winning cases that you should know about.
I have tried hundreds of disability cases over the past 25+ years and certain patterns do emerge. Rarely will my client be denied if his/her case contains the six characteristics of winning cases that I discuss in this video.
At its core, Social Security disability is about how your medical issues negatively impact your capacity to perform even a simple, entry-level job. If you keep this vocational focus in mind starting at the instant you file your claim, you will increase your chances of winning.
However your focus on diminished work capacity should not start at your hearing. Instead, address these work capacity issues with your doctor at every visit. Use clear language when you talk to your doctor. Just as you would avoid “not very far” or “not too long” when you testify before a judge, do not use these "wishy-washy" terms when speaking to your doctor.
Your medical record will reflect what you are telling your doctor, so report symptoms using specific measurements of time, distance and weight when talking to your doctor. Your specific observations will find their way into your medical record and will be noticed by your judge.
Disability judges will approve you if the evidence in your claims file confirms your diminished vocational capacity and you can help make sure that your file is one that a judge sees as compelling.
