The theoretical foundation concepts

The theoretical foundation of the concept of inheritance and succession within the Benin Kingdom takes its root from the rules that were modelled and instituted by the monarchs who ruled the kingdom from 1440 to 1473, during the era of the Ogisos.
This rule has passed through several generations and remained customary in fact to the present day.

The issue of succession in Benin Kingdom is perpetuated on the basis of the rule of primogeniture. This has been in force from the rulership of Oba Ewuakpe, particularly after the voluntary sacrifice of Queen Iden in the 18th Century. This rule specifies that the eldest surviving son of the patriarch of a household becomes his successor in fact, provided he has performed the required funeral rites of his father. This practice was perceived to be fair and peaceable. It has been the rule to this day.

Under the Bini customary law, succession and inheritance is governed by this principle of primogeniture. This is the concept of the domination of male succession. The issue of who is a legitimate or illegitimate child comes into focus to determine the right of inheritance.
