New Supreme Court Decision Affects Green Card & Immigration Cases Across America

A landmark case currently before the U.S. Supreme Court, Blanche v. Lau, could fundamentally change the rights of nearly 13 million lawful permanent residents. The court is deciding whether the government can strip returning green card holders of their "returning resident" status and put them into a difficult "inadmissibility track" based on unproven criminal charges.
⚖️ The Case: Blanche v. Lau
The case involves Muk Choi Lau, a green card holder since 2007 who was placed into "legal limbo" (parole) rather than admitted after returning from a trip abroad in 2012 due to a pending charge.
The Core Legal Question: The court must decide if the government needs "clear and convincing evidence" of a disqualifying offense at the moment a green card holder re-enters the U.S. to deny them formal admission.
The Government's Argument: Border officers should not be required to have full evidence of guilt at the airport and should be allowed to investigate later.
The Defense Argument: Allowing arbitrary parole without proof flips the "presumption of innocence" and puts all travelers at risk.
