Why House Flipping Often Struggles With the E-2 Visa

House flipping often looks like a great fit for the E-2 visa, and it is easy to see why.

It can involve a high dollar investment and it can be very lucrative.
But the E-2 visa is not based solely on investment size or profitability.

For E-2 purposes, the focus is whether the investor is running an ongoing operating business that creates jobs.

Many house flipping models are deal based. Once a property is sold, the work, and often the jobs, pause until the next deal.

That stop and start structure can raise questions about whether the business is truly real and operating on an ongoing basis.

At sufficient scale, where properties are purchased consistently, employees are retained, and operations continue without interruption, real estate businesses may be viewed differently.

The key question is not just,
“Is this a big investment?”

It is,
“Does this operate like an ongoing business that supports jobs?”

This video is for general informational purposes only and does not constitute legal advice. Every E-2 case is fact specific and outcomes may vary.
