The new policy will scrap the offence of public drunkenness.
Dangerously drunk people are to be taken home or cared for at a sobering up centre instead.
The new laws come into effect from Melbourne Cup Day, which is one of the worst days for alcohol intoxication and assaults in the state.
The first of these facilities will open in Collingwood but it will be ready by Cup Day.
