You Gotta Show Up to Win a DMV DWI Refusal Hearing

This video is about why showing up is important to your NYS DWI DMV license refusal hearing. You can never expect to win if you don't at least show up at your New York DMV license hearing. If you do not show it is a default, and an automatic lose. Yet, everyday I see and hear of attorneys not showing up, more like giving up in my estimation.
This video discusses one of my New York DMV administrative refusal wins. The police officer that showed up to the hearing did not match the cop that signed the refusal report. The cop that gave the refusal warnings was not present to cross examine. Under the sixth amendment to the constitution you have a right to confront your accusers. A refusal is an accusation by a member of law enforcement.
There are cases and situations in which waiving (giving up) a hearing is in the client's best interests overall. But in many more cases showing up, and showing up prepared, and showing up with knowledge offers the best chances of success.
Just like the lottery, you gotta play to win. This is just another game. You must participate and play fully to get your maximum value.
