section 10 cpc deals with doctrine of res sub judice or stay of suit. rus sub judice in Latin means "already in judgment". under section 10 the court is barred to proceed trial of subsequently instituted suit in which the matter is same, parties are same and the court in which previous suit is pending having jurisdiction to grant the relief claimed in subsequent suit.
