County Canceled a Disabled Veteran’s Appointment Over His Service Dog Tag #veteran #servicedog
A veteran arrived at a county office with his trained service dog for a scheduled appointment.
The clerk refused entry because the dog did not have the county's blue service-animal registry tag.
The problem was in the county's own paperwork.
The registry page said the program was voluntary. The dog had a regular license and rabies record. The incident log showed the dog was leashed, calm, housebroken, and under control. And the handler had answered the two ADA service-animal questions.
Under ADA Title II and 28 CFR 35.136, a state or local government office may ask limited questions when it is not obvious whether a dog is a service animal. It generally may not demand documentation that the dog is certified, trained, licensed, or registered as a service animal.
The court ordered the county to honor the appointment and remove the tag rule from its public counters.
This is a fictionalized courtroom reenactment for legal education and discussion. The people, county, dog, documents, and dialogue are fictional. Actual ADA rights, defenses, remedies, and filing deadlines depend on the facts and jurisdiction.
