The balance of harm test is a key legal principle under the Family Law Act 1996, used primarily when courts decide whether to grant an Occupation order. The balance of harm test requires the court to weigh the potential harm that would be suffered by the applicant if an order is not made, against the harm that would be suffered by the respondent if the order is made. A court must also consider the harm to any relevant child, with harm defined as physical, emotional, or psychological ill-treatment or impairment of health or development. In relation to children, harm can include witnessing abuse between parents.
