How to remove a hijacker from your Amazon product listing and how to report a violation using Brand Registry.

If you are selling on Amazon then at some point your FBA product listing will get hijacked by another seller.

When my product got hijacked I struggle to find a tutorial that showed how to use Amazon's brand registry to report a violation, so I decided to put together this video to show the steps that I took to get the hijacker removed from my product listing.

What is a Hijacker & Why is it possible?

• Hijackers are other sellers that use your private label product listing to sell their generic product on Amazon
• Unfortunately this is possible as Amazon owns all product listings and allows multiple sellers to sell from any listing
• Amazon allow multiple sellers to list against any product providing they are selling the exact same product
• Private label products do not have any additional protection unless you are brand registered

How to Prevent Hijackers
• Add your private label brand (logo) to your FBA product and packaging and ensure it is visible in all product photography
• Customise your product so that it isn’t identical to any other listing and is different to generic versions of the product
• Consider bundling additional item(s)
• Monitor all of your listings (I use Helium 10 “ALERTS”) - this lets me know as soon as a hijacker has won the buy box so I can act immediately

What to do if your listing gets Hijacked?
• The first step every Amazon seller should take (if you have lost the Buy Box) is to reduce your price to below the hijackers, this will usually allow you to win back the buy box.
• By winning back the buy box this reduces the risk of a customer receiving a lesser product from the hijacker as people will continue to buy your product (this reduces the risk of receiving a negative review)
• If you are BRAND REGISTERED (this requires a Trademark) then you should report a violation using Brand Registry.
• If you are NOT BRAND REGISTERED then send a “Cease and Desist” letter/email (template below) and report a violation via Seller Central (you may have to buy the product first so you can upload photos showing how the hijackers product does not match the product listing)

It has come to our attention that your Company is using the BRANDNAME brand and violating the BRANDNAME trademark to sell products on the Amazon.co.uk marketplace.

The BRANDNAME brand has trademark protection and is part of the Amazon Brand registry.
 
Our company is the exclusive distributor and the owner of the brand. We have never granted permission to your company to sell our brand nor have we sold you inventory for resale.
Amazon does not allow unauthorized selling of products as it makes Amazon liable for allowing copyright and trademark infringement. In addition, products sold under a listing must match that listing EXACTLY.

Amazon’s typical response to such cases is “...We are writing to let you know that we have removed your selling privileges, cancelled your listings, and placed a temporary hold on any funds in your seller account...”

This will serve as your legal notice to cease and desist all further actions described above.
You are hereby instructed to comply with this letter immediately or will report this to Amazon Seller Performance and Amazon Brand Registry.
You have 24 hours to comply or we will report you.

“Thank you for submitting your notice of infringement. We cannot take action on your report for the reasons listed below

As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities.

In order to ensure quality and quick resolution of your notices, we will only process the specific complaint type you have chosen on the Report Infringement or "Report a Violation" forms (such as patent, trademark, or copyright). If you have additional IP concerns, please submit additional notices of infringement."
