Listen as California Personal Injury Attorney Frank Nunes explains whether to report a car crash to your insurance company when it was not your fault.
Most insurance policies require the policyholder to report any potential claims in a timely manner. Being timely allows the insurance company to have the opportunity to investigate the crash, determine the other party’s insurance, and perhaps plan a resolution of the damages to your car – and perhaps your medial bills, if applicable.
If you fail to report the crash when it is not your fault, it could be that the other driver doesn’t have insurance coverage or doesn’t have enough coverage, then your insurance company isn’t going to have the information they need to resolve your claim in the best possible way.
One point in particular that pertains to you immediately reporting the collision is that a tow yard storing your car after they remove it from the scene will typically charge very large short-term storage fees, and your insurance company would normally act to resolve that storage issue quickly. Failing to tell your insurance company about the crash can result in unexpectedly high fees for storage at the tow yard.
Sometimes people are afraid their rates will increase from being in a collision. If they do go up, we would advise you to vote with your checkbook and use another carrier. It remains important to follow the terms of your policy, and disclose to your insurance company what needs to be reported so they can act in your interest. Watch the video to learn more.
