The divorce agreement is one of the most consequential legal instruments in family law.

When a marriage dissolves, the legal document that governs what follows — custody arrangements, alimony, property liquidation, the fate of the family home — is typically treated as a procedural requirement. The scholarly literature has not kept pace with either the complexity of these instruments or the constitutional demands now being placed on them by Mexican courts.

My new dossier, Convenio de Divorcio, published by Tirant lo Blanch, addresses this gap directly. Drawing on the Código Civil para el Distrito Federal, the Código de Procedimientos Civiles, and a curated body of binding jurisprudence, it constructs a systematic legal framework for understanding, drafting, and challenging divorce agreements — including the constitutional limits on clauses that entrench gender inequality and patriarchal power structures, as confirmed by current Mexican case law.
