The Trump administration has reached an agreement allowing the sale and possession of devices that enable the conversion of semiautomatic rifles into weapons that can fire at rates comparable to machine guns. This settlement, announced by the Department of Justice, resolves lawsuits initiated during the Biden administration, which had banned certain "forced-reset triggers."
Attorney General Pamela Bondi stated that the DOJ views the Second Amendment as a fundamental right, expressing satisfaction in ending what she described as a needless cycle of litigation that purportedly enhances public safety. However, the decision has drawn sharp criticism from gun control advocates. Vanessa Gonzalez, vice president of the Giffords organization, condemned the agreement, asserting that it effectively legalizes machine guns and could lead to increased loss of life.
In 2022, the Bureau of Alcohol, Tobacco, Firearms and Explosives had classified some of these devices as illegal under the National Firearms Act. Following this classification, the DOJ filed a lawsuit against Rare Breed Triggers, a company distributing such devices, which resulted in a court ruling prohibiting its sales.
The Biden administration had cited the prevalence of AR-15-style firearms in mass shootings as a reason for the ban. Meanwhile, a separate lawsuit from the National Association for Gun Rights challenged the legality of the Biden-era ban, leading to a Texas judge's determination that it was unlawful.
The recent settlement resolves these ongoing legal disputes, allowing owners to reclaim forced-reset triggers previously seized by the government and stating that the machine gun ban will not apply to these devices, provided they are not intended for handguns.
