🛑 Supreme Court Slams Govt's Silence on Section 80 CPC Notices | Yerikala Sunkalamma Case

The Supreme Court, in Yerikala Sunkalamma vs State of Andhra Pradesh, strongly criticized public authorities for treating Section 80 CPC notices as mere formalities. It said such notices must be taken seriously and replied to within time, or adverse inferences may be drawn.
The case involved forcible dispossession of land in Andhra Pradesh. Despite serving a statutory notice, the State ignored the appellant's communication, forcing them into prolonged litigation.
The trial court ruled in favor of the landowners, but the High Court reversed it, citing the 1977 Assigned Lands Act. However, the Supreme Court restored the trial court’s verdict, noting:
The State failed to prove that the land was "assigned."
The appellants had continuous possession since 1970, backed by Pattadar Passbooks and revenue receipts.
A presumption of ownership arose under Section 113 of the Bhartiya Sakshya Adhiniyam, 2023.
The State's silence on the Section 80 notice weakened its case.
Instead of ordering demolition of a structure built by the State, the Court awarded ₹70 Lakhs compensation to the appellants.
