"One Vote Turned the Game" || SC Steps Into Floor Test Row #courtproceedings

The Supreme Court of India heard the matter on 13 May 2026 before the Bench of Hon’ble Justice Vikram Nath, Justice Sandeep Mehta, and Justice Vijay Bishnoi.

In an important development, the Supreme Court stayed the order of the Madras High Court which had restrained TVK MLA R. Sreenivasa Sethupathi from voting in the Tamil Nadu Assembly floor test. The Court also stayed proceedings in the writ petition filed by DMK candidate K.R. Periakaruppan challenging Sethupathi’s election victory.

Senior Advocate Abhishek Manu Singhvi, appearing for Sethupathi, argued that the High Court erred in entertaining a writ petition despite acknowledging that an election petition was the appropriate remedy. Meanwhile, Senior Advocate Mukul Rohatgi, for Periakaruppan, contended that a wrongly delivered postal ballot could have changed the result, making the case exceptional.

The Supreme Court questioned the maintainability of the writ petition and emphasized that election disputes should generally be resolved through election petitions. The case arises from a closely contested election decided by a margin of just one vote.

Granting interim relief, the Supreme Court stayed the High Court’s order and allowed participation in the floor test, while giving time for filing a counter-affidavit.
