Amending Your Planning Permission: Major, Non-Material and Minor-Material | Planning Ahead with CMS
Welcome back to Planning Ahead with CMS, with our brand new series of guides on planning law and amending planning permissions in the UK. This part focuses on when and how you might amend your planning permission with: new full planning permissions (including drop-ins and slot-ins), non-material amendments and minor-material amendments.
Planning permission might need to be amended when the site plan or the market changes.
New planning permission is required when there is a fundamental change that goes to the root of what the original planning was seeking to consent to, such as a significant increase in the size or height of the development.
Non-material amendments allow changes to existing planning permissions to be made without the need for an entirely new planning application.
Minor-material amendments, although not defined in the statute, are changes similar in size and nature to the proposed development and where there are no fundamental changes to what was originally proposed.
