BRITISH CITIZENSHIP BY MARRIAGE

Getting married to a British national doesn’t promise necessarily that you will be granted British Citizenship. This is acquired through the application process of citizenship which obligates the non-British spouse to fulfil specific entitlement criteria under nationality policies. From there you should submit a citizenship application to the United Kingdom Home Office.

Entitlement of British Citizenship by marriage
To be qualified for British Citizenship via naturalisation, you should satisfy the following measures:

Qualified the life in the UK test.
Be 18 years of age or over.
In a civil partnership with, or Married to, a British Citizen.
Able to demonstrate English language knowledge, Welsh or Gaelic.
Good character.
Resided in the United Kingdom for at least three years before applying and meeting residence obligations.

When you have acquired (ILR) Indefinite Leave to Remain in the United Kingdom as a spouse of a British national, a permanent residence card or settled status under the European Union settlement scheme, you may apply for the British Nationality.

Koll obligations
To settle in the United Kingdom you need to fulfil the Koll requirement by succeeding in the “Life in the UK” test. This is done at an approved test centre. If you are from an English speaking nation for example United States of America or Australia, you will not be required to pass the language component of the exam, but still have to sit in the Life in the UK test.

It is feasible for you to be entirely excused from the language and life obligation if you are aged 65 or above, or if you have a long standing mental or physical disorder that stops you from meeting this obligation.

How to Apply for a United Kingdom marriage visa

Residency obligations
To be entitled for British Nationality, the following residency obligation should be fulfilled. You should not have:

Violated any United Kingdom immigration rules and regulations (you should not be residing illegally in the United Kingdom).
Spent over 270 days outside the United Kingdom during the previous 3 years before submitting your nationality application.
Spent over 90 days outside the United Kingdom in the previous 12 months.
Any unnecessary extra absences are a common reason for citizenship rejections. If you are worried that you have broken your absence limit or near it, you must seek advice to understand any propositions on entitlement.

Expenses
Still as a spouse of a United Kingdom national, there is a fee for visa applications. The amount is £1,330. There is also a fee of £19.20 to get your biometric information done– which includes fingerprints and photographs. The United Kingdom government will let you know how this can be done via website or print media.

Kids under the age of 18
If as a married couple you have a kid, they are certainly a United Kingdom national if they were born in the United Kingdom. They are also entitled if they were born and:

If your spouse is deceased
You had ILR or permanent residence status in the United Kingdom

If your significant other is deceased, you cannot apply for a United Kingdom visa. There are other methods to apply for British citizenship that you could be entitled for, such permanent residence status or ILR in the United Kingdom.
