Transcript- I’m Mic McConnell, I’m the head of the medical malpractice department at the Allen Law Firm. I’m often asked to explain what medical malpractice is. After thirty years of being a medical malpractice lawyer, I found that the best way to explain to my clients what medical malpractice is…is by explaining to them what medical malpractice is not. Medical malpractice is not that a doctor made a mistake. Doctors are human; they’re allowed to make mistakes. Medical malpractice is not that there was an unexpected bad outcome. Bad things sometimes happen during medical care, it doesn’t mean that there’s been medical malpractice or that the doctor did anything wrong. And it’s not medical malpractice if another doctor would have done things differently from the way your doctor did them. Doctors sometimes reasonably disagree on what the best approach to a patient problem is. It’s medical malpractice when a doctor does something unreasonable, something no reasonable physician would have done under the circumstances. And if we can prove that a doctor behaved unreasonably, we’ve proven half of the medical malpractice case, and half of a medical malpractice case is no case at all. In order to have the rest of the case, we have to prove that the injury, the bad outcome, happened because of the unreasonable behavior of the doctor…not because of the underlying injury or the underlying illness that caused you to seek medical care in the first place. Unreasonable behavior causing severe injury, that’s what medical malpractice is.
