Sometimes Russian representatives have to be persuaded to release from captivity both their own citizens and foreigners who fought against Ukraine as part of the Russian Armed Forces.
Bohdan Okhrimenko, head of the Secretariat of the Coordination Headquarters for the Treatment of Prisoners of War, stated this in an interview with Ukrinform. "We already have quite a few of them in captivity. The Russians are not interested in them in the negotiation process. There hasn't been a single request from the Russian side, except for the North Koreans. They've asked several times whether we're willing to hand them over," he emphasized.
Responding to a question about two North Korean prisoners who do not want to return to their homeland and instead request to be handed over to South Korea, Okhrimenko noted that this is a sensitive issue, since, according to international humanitarian law, the country that involved them in the armed conflict bears responsibility for them. According to him, the Third Geneva Convention provides for the principle of non-refoulement, so if a prisoner of war does not want to return and there is no other mechanism, Ukraine will detain him for as long as it takes to resolve the issue. Responding to a question about the fate of two Chinese who fought against Ukraine a year ago and were captured, Okhrimenko said that Russia had not inquired about their fate from Ukraine.
"They fought on the side of Russia, and China is not a party to the conflict. According to the Geneva Convention, the country on whose side they fought is responsible for its military personnel. If China criminalizes mercenarism, then its citizens who participated in an armed conflict on the side of a third country could be convicted upon their return," he said.
At the same time, Okhrimenko noted that, knowing Russia's meanness in all matters, he would not be surprised if it turns out that these are Chinese with Russian passports, of whom there are many in certain regions of Russia. Okhrimenko noted that since its inception in 2022, the Coordination Headquarters for the Treatment of Prisoners of War has already returned 9,048 of our people.
According to him, the transfer of prisoners takes two days, but negotiations on categories such as those captured at the Chernobyl Nuclear Power Plant, the Zaporizhzhia Nuclear Power Plant, in Mariupol, Bakhmut, Pokrovsk, and the Kursk region of Russia last for years, and our people, whom Russia has currently agreed to release, could be included in a separate exchange. Negotiations regarding prisoners of war convicted in Russia have also dragged on for years. He added that Ukraine has prepared a legislative framework for including convicted Russian soldiers in exchanges, while in Russia, this is a lengthy process that includes a pardon for our soldiers by dictator Putin.
Okhrimenko reported that more than 20 wrongfully convicted prisoners have already been returned this year. There was also a major prisoner exchange on October 18, 2024, when more than 40 "convicts" were returned, half of whom were serving life sentences, and the other half were serving long prison terms.
"Last year, there were also exchanges involving 'convicts,' and we continue to work to return our citizens who Russia subjected to trumped-up trials," he emphasized.
