The #Florida #workerscompensation system is meant to provide compensation to individuals injured on the job efficiently and timely. So why are some claims denied?
Today I’ll highlight 10 of the most common reasons for #denials.
No #workplace #injury - If you weren’t at work on the day you were injured then you are not entitled to benefits from workers’ compensation. If you file a lawsuit a judge will ultimately decide the outcome.
Your injury is not covered - #mental #health injuries alone are not enough to qualify for workers’ compensation. For example, if you were held up at gunpoint but not injured, you’re not covered. Conversely, if you’re held up at gunpoint and it included aggravated battery, then you would be covered for your injuries and mental health.
Late reporting - You have 30 days from the time of your injury to report it. Don’t try to be a hero and beat the pain. You need to make sure you keep records and report all symptoms.
Lack of witnesses - having #witnesses never hurts your claim. It adds credibility to your situation. Make sure that you document everything from the location of your injury to the people who were near you.
Inconsistent stories - If you change your story every time you tell it, there is a lack of credibility and it will throw a red flag. Make sure you’re telling the entire truth from the beginning. Don’t embellish and don’t play it down either.
Preexisting conditions - In Florida, you have to be able to show that the accident caused more than 50% of your injuries. If the insurance company looks back and sees that you have a history of the same type of injury, your claim may be denied.
Lack of cooperation - There is no board of trustees making decisions about your workers’ comp claim. The person who decides is an everyday person like you or me. It’s important to realize that they are just a human and cooperation goes a long way. If they feel as though you’re not cooperating then the process may take a lot longer.
Intentionally injure yourself - If you purposely hurt yourself then you’ll be denied your claim. Additionally, if you choose not to use the safety equipment that is provided to you then your benefits may be lower.
Drug use / Intoxication - If your job requires an ‘after injury drug or intoxication’ test and you fail it, you don’t get benefits. It’s assumed that the intoxication caused the injury. If you refuse the test, it’s assumed that the test was positive.
Fighting at work - The aggressor does not get workers’ compensation benefits. If neither person admits to being the aggressor, it will go to a judge and s/he will decide.
