Energy Transition: COP28 and Industry Impact - Regulation

White & Case partner Serena A. Rwejuna discusses COP28 and, in particular, the impact of climate action, accountability and inclusivity on regulatory developments worldwide. Serena provides insight on new climate disclosure reporting requirements across the globe, including the obligations on public and private entities in the US for reporting Scope 1 through to Scope 3 emissions, which include indirect supply chain emissions, which will become effective in 2024, as well as, the EU’s Directive on corporate sustainability reporting (CSRD), which came into force in 2023, mirroring SEC and California rules adopted in the US. Serena closes by highlighting the global focus on prioritizing equity throughout the energy transition, including the Biden Administration’s Justice40 Initiative through which the US Federal Government has made it a goal that 40 percent of the overall benefits of certain record-breaking Federal investments flow directly to disadvantaged communities that are marginalized, underserved, and overburdened by pollution.
