Defense attorneys share the biggest trends in medical malpractice claims:

1. The physician-patient relationship is at risk: Because physicians have less time to spend with patients, the relationship is more fragile, and patients may be more likely to sue after an adverse outcome.

2. The loss of independent practitioners to hospitals means more claims are being brought against hospitals and institutions. To protect their reputation, hospitals may wish to settle instead of going to trial.

3. Physicians are being deposed as fact witnesses in claims against hospitals.
