WHAT IS UNDERTAKING IN LAW OF PAKISTAN?

In the law of Pakistan, an undertaking generally refers to a formal promise or assurance given by a party, typically in written form, to do or not to do something. It has legal force and is often used in court proceedings or administrative matters.

TYPES OF UNDERTAKING

JUDICIAL UNDERTAKING:-

Given to a court as part of legal proceedings. For example, a party may give an undertaking not to dispose of property while a case is ongoing.

ADMINISTRATIVE UNDERTAKING:-

Given to government departments or regulators (like PEMRA, FBR, or SECP), ensuring compliance with laws or conditions

CONTRACTUAL UNDERTAKING:-

A promise within a contract that one party will or won’t do something

LEGAL EFFECTS:-

A person who gives an undertaking is bound by it, and failure to comply can result in contempt of court, penalties, or other legal consequences.

NOTE:-

Courts in Pakistan treat undertakings seriously, especially when they’re used to avoid certain legal actions (e.g., arrest, enforcement, etc.).
