EP 4|2026: No consultation - no mining
Consultation can make or break a mining licence in South Africa.
Yet it remains one of the most misunderstood — and most litigated — requirements under the Mineral and Petroleum Resources Development Act (MPRDA) and the EIA Regulations.
In this video, we explain who must be consulted, why consultation is legally required, and how communities and the public must be informed of a proposed mining project in order to submit comments and objections.
In this video, you will learn:
1️⃣ Who must be consulted in terms of the MPRDA and EIA Regulations
2️⃣ Which additional parties, not expressly listed in the legislation, courts have ruled should have been consulted
3️⃣ How the public must be notified of a proposed mining project
4️⃣ Why proper and complete identification of Interested and Affected Parties (I&APs) is critical to avoid future disputes and litigation arising from inadequate consultation
This is Part 2 of our consultation series unpacking one of the most decisive compliance risks in the mining licence process.
👉 If you missed Part 1, we strongly recommend watching it here:
https://youtu.be/SunZgEOpyP8?si=-i8w7JWnv_PUAFoy
📌 Key principle:
If communities are not meaningfully consulted, the mining right is vulnerable — regardless of investment size or project stage.
🎥 This video is relevant for:
Communities affected by mining
Mining companies & mining right applicants
Community representatives & traditional authorities
