Shazam is the name now given to the original Captain Marvel, who appeared under that name in a series of comic books and spin-offs published from 1940 to 1953 by Fawcett Publications. Because his powers were very similar to those of Superman, and because Captain Marvel was outselling Superman, DC Comics sued Fawcett for copyright infringement, a trial which ended with Captain Marvel ceasing publication (but by that time costumed heroes seemed to have run their course anyway). DC licensed the character in 1972 and returned him to the newsstand, eventually buying all the Fawcett characters outright in 1991. Because the trademark for the name “Captain Marvel” has been allowed to lapse in the meantime, Marvel Comics had established its own “Captain Marvel,” requiring DC to use the name “Shazam!” on the cover.
