Capacity, Incapacity and Human Rights: A CRPD Perspective

On 17 March, 2017, the United Nations will formally initiate its first-ever review of the compliance of the United Kingdom with the UN Convention on the Rights of Persons with Disabilities (CRPD). The review will open the latest chapter in an ongoing struggle to bring a human rights perspective to the practice of care-provison (health care, social care, psychiatric care, eldercare, etc.). What is the CRPD and what should we expect from the upcoming review? Is UK capacity law in violation of the UK’s international human rights commitments? If so, what needs to change? How are the various devolved legislative bodies of the UK responding to the challenge of CRPD-compliance? This talk will provide an overview of the history of the Convention, a review of the relevant procedures and authorities, and a survey of the (sometimes intense!) controversies that have surrounded this interface among international law, domestic legislation, and the concrete realities of delivering care to persons whose decision-making abilities may be impaired by disabilities.
