Courts have begun holding governments to legally enforceable duties to protect people from climate harm — the European Court of Human Rights in KlimaSeniorinnen v. Switzerland (2024) and the Dutch Supreme Court in Urgenda v. Netherlands (2019). But every one of those cases rests on a precondition: the emissions could be measured and attributed.
This video examines what happens when that precondition fails. As AI's energy and water demands climb toward industrial scale, there is still no AI-specific obligation to disclose that footprint in a form a court could use. The result is a structural accountability gap: you cannot litigate what you cannot measure, and you cannot measure what the law does not require to be disclosed.
Why now: AI's environmental footprint is becoming quantifiable just as climate jurisprudence matures — yet the disclosure rules haven't followed.
