Discretionary Powers of the Governor (Article 163) #jpsc#bpsc#ugcnet
Discretionary Powers of the Governor (Article 163)
Unlike the President of India (who has no constitutional discretion and is strictly bound by the Council of Ministers), the Governor enjoys both Constitutional and Situational Discretion.
Article 163(1): There shall be a Council of Ministers with the Chief Minister at the head to aid and advise the Governor, except in so far as he is required to exercise his functions in his discretion.
Article 163(2): If any question arises whether a matter falls within the Governor’s discretion, the decision of the Governor is final.
1. Constitutional Discretion (Explicitly Mentioned in the Constitution)
These are powers where the Constitution itself gives the Governor the authority to act independently of the state cabinet:
Reserving a Bill for the President (Article 200): The Governor can reserve certain bills passed by the state legislature for the consideration of the President (e.g., if a bill endangers the position of the State High Court).
Recommendation of President’s Rule (Article 356): Recommending to the President to impose Article 356 if the Governor feels that the state government cannot be carried on in accordance with the provisions of the Constitution.
Seeking Information from the Chief Minister (Article 167): The Governor can call upon the Chief Minister to submit information regarding administrative and legislative affairs of the state. #jpsc #jpsc2026 #education #jpscprelims #jharkhandgk #upsc #jharkhandpsc #jharkhandcivilservices #jpscanswerkey #civilservicespreparation
While acting as an Administrator of an adjoining UT: If given additional charge of a neighboring Union Territory, the Governor acts independently of the state council of ministers.
Special Tribal Area Allowances: Determining the amount payable by the governments of Assam, Meghalaya, Tripura, and Mizoram to an autonomous Tribal District Council as royalty from mineral exploration.
2. Situational Discretion (Derived from Political Exigencies)
These powers are not explicitly written down but arise due to specific political situations or crises:
Appointment of Chief Minister in a Hung Assembly: When no single political party or pre-poll alliance secures a clear majority after an election, or when an incumbent Chief Minister dies in office without a clear successor.
Dismissal of the Council of Ministers: If the Ministry loses the confidence of the State Legislative Assembly (Lower House) but refuses to resign, the Governor can dismiss them.
Dissolution of the Legislative Assembly (Article 174): The Governor can dissolve the assembly if the Council of Ministers has lost its majority and no alternative government can be formed.
3. Special Responsibilities (Under President's Directions)

The Governor also has specific regional discretionary powers under Article 371, where they consult the local ministers but take the final call independently based on the President's directives: #spsc #sscexam #modelpapers #sscexam #sejc #upscaleresale #rsce #answerkey #ssc #ssc #rsce #sscboard #answerkey #ssccgl #ssce #sscstenographer #intermediateexams #answersheets #cssexams #ssccoaching #jpsc2026 #education #jpscprelims #jharkhandgk #upsc #jharkhandpsc #jharkhandcivilservices #jpscanswerkey #civilservicespreparation #spsc #sscexam #modelpapers #sscexam #sejc #upscaleresale #rsce #answerkey #ssc #ssc #rsce #sscboard #answerkey #ssccgl #ssce #sscstenographer #intermediateexams #answersheets #cssexams #ssccoaching
